“Personal data” means all specific information relating to an identified or identifiable natural or legal person related to private or material conditions. In other words, it is information which may be associated to you personally and which may communicate something about you. The term “your data” is also used in this data protection information section with the same meaning. “Processing” or “process” means any handling of your data, i.e. in particular the collection, storage, management, use, transmission, communication or deletion of your data.

Information about what personal data we collect and store when you use our website and how we use such data, as well as who we may transfer it to, is provided below. In addition, you will find information about your rights towards us regarding the use of your data.

a) while you visit our website

When you visit our website, the web server records technical information in so-called log files, such as date, time, the website, the data you downloaded, the website through which you landed on our website or the type of browser you use (including the operating system). Sea World Distribution SA stores and uses this information anonymously for statistical analysis purposes and to improve the attractiveness of the website. Also, we use this information in a pseudonymized manner, i.e. without reference to you, so that we can continuously improve our offer and adapt it to your specific interests.

In addition, we activate cookies and analysis tools (e.g. Google Analytics) when you visit our website. Please refer to sections 9 and 10 of this data protection information.

If you have signed up to receive our newsletter, we will use your data entered at the time of registration to send you Sea World Distribution SA ’s newsletter. If you no longer wish to receive our newsletter, you can unsubscribe via a cancellation link in each newsletter.

c) Communication

We store and use your data when you contact us by telephone, e-mail or via our contact form or if you otherwise decide to provide us with information – including the content of the communication – and send us your data in order to do so.

d) Other uses

In addition, we store and use personal data and technical information to the extent necessary to prevent or pursue abuse or other unlawful conduct on our website, e.g. to maintain data security in the event of attacks on our IT systems.

Finally, we store and use your data to the extent that we are required to do so by law, e.g. in accordance with official or judicial orders and for the protection of our rights and claims, as well as for legal defense purposes.

In general, there is no obligation to disclose personal data to us, unless there is a contractual relationship that substantiates this obligation. However, we will have to collect and process personal data that is necessary or required by law in order to initiate and manage a contractual relationship and for the fulfilment of the obligations associated with it. Otherwise, we will not be able to enter into or proceed with the contract in question. In fact, the processing of log data and certain other data during the use of the website is also imperative. Even when you are communicating with us, we must process at least the personal data that you transmit to us or that we transmit to you.

For the conclusion and fulfilment of contracts, we may transfer your personal data to companies within the Sea World Distribution SA group of companies both within and outside Switzerland, for central storage in the client database and for invoicing and internal group accounting purposes. In the case of cooperation with a partner company for a specific product offer, a payment method or a prize contest, your personal data may also be transferred to that company. In addition, we have partial data (e.g. for IT and central hotline services, market research and client satisfaction analyses) processed by service companies that we select with care and that can only operate in accordance with our instructions.

Please also take note of para. 10 concerning data transmission in the context of client evaluations.

We implement technical and organizational security measures to adequately protect your personal data against unauthorized access, misuse, inadvertent or intentional manipulation, loss or destruction. Personal data that requires special protection is transferred in encrypted form (e.g. by using SSL = Secure Socket Layer protocols). The technical security measures to protect your personal data are regularly checked and, if necessary, adapted to the state of the art. These principles also apply to companies that process and use personal data on our behalf and in accordance with our instructions.

Within the scope of the legal authorization in accordance with Art. 3 para. 1o of the federal Unfair Competition Act (LCD), we are entitled to use the e-mail address that you have indicated when purchasing goods, work or services for the direct advertising of similar goods, work or services. If you no longer wish to receive advertisements for similar goods, work or services, you may object at any time to your e-mail address being used for such purpose, without incurring any additional costs. For this purpose, you can unsubscribe from product recommendations by clicking on the unsubscribe link in each email.

We retain your personal data only as long as it is necessary in accordance with the purposes of their processing. In the case of analysis, we store your personal data until the analysis has been completed. If we store personal data as a result of a contractual relationship with you, such data will be retained at least for as long as our contractual relationship exists and at most for as long as we have a legitimate interest in the storage of such data, e.g. for documentation and evidence protection purposes; during the limitation periods for possible claims on our part or as long as there are legal or contractual obligations to store such data.

“Automated individual decisions” are decisions that are made in an automated manner, i.e. without significant human influence and which may have negative legal or other similar negative consequences for you. We will inform you separately if we have to use automated individual decisions.

If we use your data for a purpose that requires your consent in pursuance of legal provisions, we will always ask for your express agreement and record your consent in accordance with legal data protection regulations. You may revoke the agreement given at any time with effect for the future and/or object to future use of your data for advertising, marketing and opinion polling purposes. Please note that for technical reasons your objection/withdrawal may take some time to be implemented and you may still receive messages from us during this period. To object to the use of your data, please follow the instructions provided therein. For the rest, it is sufficient to send us a message to withdraw your consent or object to the use of your data, using our contact details.

Within the scope of the law applicable to the treatment of your data, you also have a right to information, rectification, deletion, restriction and objection to the treatment of your data by us, as well as the right to receive your personal data provided to us in a readable format free of charge. To exercise your rights, you can contact us using our contact details.

Please note that this data protection policy may be amended from time to time. We therefore recommend that you consult this data protection policy regularly. Any substantial changes to our data protection policy will be communicated to registered users by e-mail, at the e-mail address provided during registration, or by appropriate notice when you log into your user account.

Third parties’ websites that can be accessed via our portal are not subject to the principles set out herein. We take no responsibility for compliance with data protection regulations on the part of third-parties’ websites.

Cookies, web analytics and social media services

Information that can identify you can be stored on your computer. Such information is referred to as a cookie. These text files stored on your hard drive allow us to recognize you as a registered customer and make it easier for you to use our website. You can examine and delete cookies stored on your computer and generally control the presence of cookies using the settings of your Internet browser.

Most browsers accept cookies as standard settings. You can, however, configure your browser in such a way that it rejects cookies or requires prior confirmation from you. If you do not accept cookies, you may not be able to make full use of all the functions of our website.

Through advertising partners or advertising networks, we activate advertising messages on other websites. These advertising partners use so-called third-party cookies which are activated when you visit our website and which can only be removed by the respective advertising partners. These third-party cookies are used to measure results and for counting purposes within advertising campaigns conducted by us in conjunction with our advertising partners. In this context, no personal data is stored and only the recall of our pages is recorded, via an advertising campaign activated by the respective advertising partner. Third-party cookies are temporarily stored cookies that remain stored in your browser for a maximum of 540 days after the last recall, after which they automatically expire.

You can examine and delete cookies stored on your computer and generally control your relation to cookies via the settings of your Internet browser. You can receive more detailed information about this from the manufacturer or via the help function of your Internet browser. Please note that the functions of our website may be restricted or not accessible if you do not authorize cookies.

We want to show you only advertising messages that really interest you. For this reason, at project-idea.ch we use the so-called “retargeting” technology, so that advertising is commensurate with your interests. When you visit our website, our retargeting partners store temporary cookies on your terminal via your Internet browser. These temporarily stored cookies enable our retargeting partners to recognize visitors to our website again under a pseudonym and to display only advertising messages for products which our visitors are likely to be interested in.

Temporary cookies allow our retargeting partners to track and store the click path of our visitors under a pseudonym. In this context, only data relating to your use of project-idea.ch is collected (e.g. number of seaworld-distribution.com page recalls, internal search requests, product page recalls, login status, recall of the order confirmation page). We do not pass on any personal data to these retargeting partners; retargeting partners do, however, collect information about the use of our website in order to provide their services. The retargeting partners may combine the information collected from you with data from other websites that you have visited and may use this data for their own purposes (e.g. to manage the advertising of their partner websites). If you have registered with the retargeting partner in question, the retargeting partner may identify you.

If you do not wish to receive personalized advertising messages via retargeting, you have one of the following options available to stop this with effect for the future:

On the one hand, as with other third-party cookies, you can control the use of cookies via your browser settings and, for example, only accept the storage of temporary cookies with your permission. Please read the section “Use of cookies”. A further possibility to opt-out is to click on the opt-out link that appears in each of the retargeting advertising media used by our partners. This link is an “i” or the gray name of our service provider on the respective advertising medium. By clicking on the link you will get to the page of our advertising partner where you can deactivate the advertising services. Please note that in order to deactivate the retargeting a so-called opt-out cookie will be stored on your terminal via your Internet browser. Your objection will therefore only be effective if you use the same Internet browser and accept, without deleting it, this opt-out cookie. If you wish to use a different Internet browser, please use one of the two options to opt-out with this browser as well.

You can delete these cookies via the so-called Google Tag Manager, which is used by this website, with a single link, click here: Deactivate Google Analytics. This will give you the option to opt out of all Google Tag Manager tags via a cookie.

This website uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website will normally be transmitted to and stored by Google on servers in the United States. However, Google will first abbreviate your IP address within Member States of the European Union or other countries that are parties to the Agreement on the European Economic Area. Your full IP address will be transmitted to a Google server in the USA and shortened there only in exceptional cases. Google will use this information on behalf of the operator of this website for the purpose of analyzing your use of the website, compiling reports on the website activity for the website operator and providing them other services relating to the website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be linked to any other Google data.

You may refuse the storage of cookies by selecting the appropriate settings on your browser. You may also prevent Google from recording the data generated by cookies about your use of the website (including your IP address) and from the processing of this data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=it.

In addition, we use Google Analytics to analyze data from the DoubleClick cookie for statistical purposes. If you do not wish this to be done, you can deactivate this function through the preference manager for advertising messages. We also use Floodlight tags from Google DoubleClick to support online advertising and to analyze the use of our website. With these tags no personal data is transmitted to Google DoubleClick. Details on how your data is handled by DoubleClick, the use of cookies in this context, as well as the possible deactivation of cookies can be found in DoubleClick’s data protection policy at: https://policies.google.com/technologies/ads?hl=it.

We use the “visitor behavior pixel” of Facebook Inc., 1601 S. on our website. California Ave, Palo Alto, CA 94304, USA (“Facebook”) to measure the effectiveness of online marketing measures. With your help, we can track user behavior after they have viewed a Facebook ad and/or clicked on it and subsequently placed an order. In this way, we can measure the effectiveness of Facebook advertisements for statistical and market research purposes. The data collected in this way is anonymous for us, in the sense that we cannot see the personal data of individual users or link it to a user together with other information.

However, this data is stored and processed by Facebook. In this way, Facebook can track the behavior of users who have clicked on an advertisement in the Facebook member area and have been directed to our website. By using cookies, i.e. text files that are stored on your computer, Facebook can ultimately recognize this user in the Facebook member area and optimize the efficiency of advertising messages, e.g. by offering messages aimed at target groups in accordance with the Facebook data usage policy. This only applies to users who have a Facebook account and are registered in the Facebook member area. Users who are not members of Facebook are not affected by this data treatment.

You can object to such data processing at the following link: http://www.aboutads.info/choices/

Our website uses the services of providers, in particular Google Analytics, a web analysis service of Google Inc. USA, as well as the “like” social plugins of Facebook Inc. USA (hereinafter referred to as “providers”). These services collect information and may use so-called “cookies”, i.e. text files that are stored on your computer and allow an analysis of your use of our website. By using social plugins, buttons from the respective provider (e.g. the Facebook “Like” button) are displayed or content from the provider in question is integrated into the website. If you call up a website that uses such a social plugin, your browser creates a link to the respective provider. The content of the social plugin is transmitted to your browser by the provider concerned and integrated by this provider into the website in question. The information generated by your use (including your IP address) is transmitted to the servers of these providers, either in Switzerland or abroad, where it is stored and processed and may be linked to your account with these providers. We have no control over the processing of data by third party providers. We therefore recommend that you check the respective data protection policies of these third-party providers. The data protection policy of Facebook can be found here.

Providers may use this information to analyze your use of our website, to compile reports on website activities for the website operators, to place display ads (banner ads) and to provide further services related to the use of the website and the Internet. Providers will also pass this information on to third parties both in Switzerland and abroad if necessary. You acknowledge and agree that there may be no adequate legal data protection abroad. By using this website, you state that you accept the use of cookies and similar technologies.
